§ 1 About This Privacy Policy

This Privacy Policy governs the collection, use, storage, and disclosure of personal data by 8k84 in connection with the 8k84.co platform and all associated services. 8k84 is the data controller responsible for personal data processed under this Policy.

This Policy applies to all individuals who interact with 8k84 in any capacity, including registered members, prospective members who browse the platform without registering, and individuals who contact 8k84 customer support. It covers data collected through the 8k84 website, any mobile-optimized interfaces, and all communication channels operated by 8k84.

Under the Philippine Data Privacy Act of 2012 and its Implementing Rules, 8k84 relies on the following legal bases for processing personal data:

• Contract Performance: Processing necessary for the performance of the member agreement — including account management, game access, payment processing, and customer support — is conducted on the basis of contractual necessity.
• Legal Obligation: Processing required to comply with applicable Philippine laws and regulations — including KYC/AML obligations under the Anti-Money Laundering Act (AMLA), reporting obligations to gaming regulators, and age verification — is conducted on the basis of legal obligation.
• Legitimate Interests: Processing for fraud prevention, security monitoring, platform integrity, and responsible gaming monitoring is conducted on the basis of 8k84's legitimate interests, balanced against your rights and interests as a data subject.
• Consent: Processing for optional purposes such as marketing communications and personalised promotions is conducted on the basis of your freely given, specific, and informed consent, which you may withdraw at any time.

§ 5 Sharing Your Personal Data

5.1 No Sale of Data. 8k84 does not sell, rent, or trade your personal data to third parties for their independent marketing or commercial purposes under any circumstances.

5.2 Service Providers. 8k84 engages third-party service providers who process personal data on our behalf under strict data processing agreements. These include: payment processors and e-wallet providers (for transaction facilitation), KYC/identity verification service providers, IT infrastructure and cloud hosting providers, customer support platform operators, and fraud detection and security service providers. All such providers are required to process data only as instructed by 8k84 and to apply security standards at least equivalent to those described in this Policy.

5.3 Game Providers. Certain operational data — such as your account identifier, game session parameters, and bet amounts — is shared with third-party game providers whose titles appear in the 8k84 library for the purpose of game delivery and result settlement. This data sharing is necessary for the performance of your account agreement.

6.3 No Third-Party Advertising Cookies. 8k84 does not deploy third-party advertising cookies or tracking pixels that share your browsing data with advertising networks for the purpose of serving targeted advertisements on external websites.

§ 7 Data Security

8k84 implements a multi-layered security framework to protect your personal data from unauthorised access, disclosure, alteration, or destruction. Security measures in place include:

• Transport Layer Security (TLS) encryption for all data transmitted between your device and 8k84 servers
• Encryption at rest for sensitive personal data stored in 8k84 databases, including KYC documents and financial records
• Role-based access controls limiting internal access to personal data on a need-to-know basis
• Comprehensive audit logging of all access to sensitive data categories
• Regular security assessments and penetration testing by qualified third-party security professionals
• Multi-factor authentication requirements for internal staff accessing production systems

In the event of a personal data breach that poses a risk to your rights and freedoms, 8k84 will notify the National Privacy Commission within 72 hours of becoming aware of the breach, and will notify affected individuals without undue delay where required by law.

§ 8 Data Retention

8k84 retains personal data for as long as is necessary to fulfil the purposes described in this Policy, or as required by applicable Philippine law and regulations. The following general retention periods apply:

• Active Account Data: Retained for the duration of your active account membership and for a period of five (5) years following account closure, in compliance with gaming regulatory and AMLA record-keeping requirements.
• KYC and Identity Documents: Retained for a minimum of five (5) years from the date of verification or account closure, whichever is later, in accordance with AMLA obligations.
• Transaction and Gaming Activity Records: Retained for five (5) years from the date of each transaction or gaming session, consistent with regulatory record-keeping requirements.
• Customer Support Records: Retained for three (3) years from the date of the support interaction, or longer where the matter is subject to an unresolved dispute or legal proceeding.
• Marketing Consent Records: Retained for the duration of your opt-in consent and for a reasonable period thereafter as evidence of consent.

§ 9 Your Data Rights Under Philippine Law

As a data subject under the Philippine Data Privacy Act of 2012, you have the following rights with respect to your personal data processed by 8k84. These rights may be exercised by contacting the 8k84 Data Privacy Officer using the details in Section 14 of this Policy.

8k84 will acknowledge rights requests within five (5) business days and will endeavour to fulfil them within thirty (30) days. Where a request requires additional time or clarification, we will notify you and provide an updated timeline. There is no charge for exercising your rights, though 8k84 may charge a reasonable administrative fee for manifestly unfounded or excessive requests.

If you are not satisfied with how 8k84 has handled your rights request or a data protection concern, you have the right to lodge a complaint with the National Privacy Commission (NPC) of the Philippines.

§ 10 Children and Minors

The 8k84 platform is strictly intended for adults aged 21 years and above in accordance with Philippine gambling law. 8k84 does not knowingly collect personal data from persons under the age of 21. Registration attempts by individuals under 21 are rejected through our age verification processes.

If 8k84 becomes aware that personal data has been collected from a person under 21 years of age without appropriate verification, we will take immediate steps to delete such data and close the associated account. Any balance held in such an account will be processed in accordance with applicable law and regulatory guidance.

Parents and guardians who believe that a minor in their care has registered on 8k84 or accessed the platform using an adult's credentials are encouraged to contact 8k84 customer support immediately. 8k84 treats such reports with the highest priority.

§ 11 Cross-Border Data Transfers

8k84's primary operations are based in the Philippines and personal data is stored and processed predominantly on servers located in the Philippines or in countries with comparable data protection standards. Where data is transferred to service providers operating outside the Philippines — for example, cloud infrastructure or game engine providers — 8k84 ensures that appropriate safeguards are in place.

Such safeguards include: contractual clauses requiring the recipient to apply data protection standards at least equivalent to those required by Philippine law; selection of service providers in jurisdictions recognised as providing adequate protection; and implementation of technical measures such as encryption and pseudonymisation where appropriate.

§ 12 Marketing Communications

12.1 Opt-In Basis. 8k84 sends promotional communications — including bonus offers, new game announcements, and platform updates — only to members who have affirmatively opted in to receive such communications during registration or through their account settings. Marketing communications are not sent to members who have not provided explicit opt-in consent.

12.2 Communication Channels. Marketing communications are sent via email and/or SMS to your registered contact details. You may specify your preferred communication channel, or opt in to one channel while opting out of another, through your account notification preferences.

12.3 Unsubscribing. You may withdraw your consent to receive marketing communications at any time by: (a) clicking the "unsubscribe" link in any 8k84 marketing email; (b) updating your notification preferences in your 8k84 account settings; or (c) contacting 8k84 customer support. This personalisation uses only data from your own account and does not involve profiling for automated decision-making that produces significant legal effects.

§ 13 Changes to This Privacy Policy

8k84 reviews this Privacy Policy periodically and updates it to reflect changes in our data processing practices, applicable law, or regulatory guidance. The "Last Updated" date at the top of this Policy indicates when the most recent revision was made.

Where changes are material — for example, introducing a new category of data collection, a new purpose for processing, or a significant change to your rights — 8k84 will provide at least fourteen (14) days' notice via email to your registered address and a prominent notification on the 8k84 platform prior to the changes taking effect.

For minor, non-material changes such as clarifications of existing language, structural improvements, or corrections of typographical errors, the updated Policy will take effect from the date of publication without prior notice. Your continued use of the 8k84 platform following the effective date of any amendment constitutes acceptance of the revised Policy.
